The terms that apply when you order through Bevendo, including payments, delivery, age checks, cancellations, refunds and your rights as a customer.

1. Purpose and Scope

These Terms set out the basis on which customers may access and use Bevendo’s digital platform at bevendo.co.uk (the “Website”), place orders and use related Bevendo services.

They apply to all customer use of the Website and should be read together with the related Bevendo policies referred to below.

Bevendo Ltd (“Bevendo”, “we”, “us” or “our”) operates a digital platform facilitating the sale and delivery of alcohol by independent licensed wine and drinks merchants (“Retail Partners”) to customers.

Each Retail Partner remains the seller of the products it supplies.

Bevendo acts as the Retail Partner’s agent to solicit and conclude contracts for orders in the Retail Partner’s name and on its behalf, and to collect payment from customers as payment agent on the Retail Partner’s behalf.

Delivery may be carried out directly by Bevendo, including through a Bevendo-operated or dedicated delivery fleet, or through one or more independent third-party delivery or logistics providers appointed by Bevendo from time to time.

Nothing in these Terms affects your statutory rights as a consumer.

By using the Website or placing an order through Bevendo, you agree to these Terms.

3. Eligibility and Age Restrictions

You must be aged 18 or over to use Bevendo to purchase alcohol.

By placing an order, you confirm that you are 18 or over and that the person accepting delivery will also be 18 or over.

Alcohol deliveries are subject to Bevendo’s Age Verification Policy, including Challenge 25 checks at delivery.

A rider may refuse delivery where the required age-verification checks cannot be completed, where the recipient is under 18, appears intoxicated, or where another ground for refusal under that Policy applies.

4. Using Bevendo

You must provide accurate information when using Bevendo and keep any account or login details secure.

Please tell us promptly if you believe your account or access credentials have been misused.

You must use the Website only for lawful, personal and non-commercial purposes.

You must not misuse the Website, attempt unauthorised access, interfere with its operation, commit fraud, impersonate another person or use Bevendo in a way that breaches applicable law.

5. Retail Partners, Products and Availability

Retail Partners are responsible for the products they sell, including their quality, safety, labelling, description and compliance with applicable law.

Bevendo provides the marketplace and customer-facing ordering service.

All products are subject to availability.

Images and descriptions are intended to help you identify products, but minor non-material differences in packaging or label design may occur.

This does not permit substitution of a different product, wine, vintage, producer or bottle size without your agreement.

If a product becomes unavailable after you order, we may contact you on behalf of the Retail Partner.

A substitute will not be supplied unless you expressly agree to it before collection.

If an unavailable product cannot be supplied, the relevant amount will be refunded.

6. Orders and Order Confirmation

When you submit an order, you are asking to purchase the selected products from the relevant Retail Partner.

Your order is not confirmed until Bevendo sends you an order confirmation on behalf of the Retail Partner.

The contract for the sale of the products is between you and the Retail Partner and comes into existence when Bevendo sends you the order confirmation on the Retail Partner’s behalf.

Bevendo may decline or cancel an order before confirmation, including where:

  • products are unavailable;
  • payment cannot be authorised;
  • the delivery address is outside the service area; or
  • there is a reasonable legal, fraud or safety concern.

7. Prices, Payment and Promotions

Prices may change before you place an order.

The total price, including any applicable delivery or other charges, will be shown at checkout before you confirm your order.

Prices shown include VAT where applicable.

Once your order has been confirmed, the price will not change.

If there is an obvious pricing error, we will contact you as soon as reasonably possible and give you the choice of proceeding at the correct price or cancelling the order and receiving a full refund of any amount paid.

Payment is collected by Bevendo on behalf of the Retail Partner using the payment methods made available at checkout.

Payment to Bevendo for the products satisfies your obligation to pay the Retail Partner for those products.

Promotional codes, discounts and offers may be subject to additional conditions shown with the promotion, including minimum spend, expiry dates, eligibility or usage limits.

We may refuse or reverse a promotion where it has been used fraudulently or contrary to its stated conditions.

8. Delivery

We will show an estimated delivery time before or after you place your order.

Delivery times are estimates and may be affected by factors such as:

  • Retail Partner preparation time;
  • traffic;
  • weather;
  • demand; and
  • rider availability.

You are responsible for providing:

  • a complete and accurate delivery address;
  • a working telephone number; and
  • any access information reasonably needed to complete delivery.

You must ensure that an eligible recipient is available to receive the order.

You must not ask for alcohol to be left unattended, in a safe place, with a neighbour, at building reception or with another person who has not satisfied the applicable age-verification requirements.

If delivery cannot be completed for a reason attributable to you or the recipient, including an incorrect delivery address, being unavailable to receive the delivery or failure to satisfy the Age Verification Policy, the order will be handled in accordance with our Refund and Returns Policy.

Bevendo may retain the delivery fee and, where applicable, take into account reasonable additional delivery or return costs, to the extent permitted by law.

9. Cancellations, Refunds and Returns

Your cancellation, refund, return and replacement rights depend on the circumstances and the type of product concerned.

They are explained in Bevendo’s Refund and Returns Policy, which forms part of the customer service process for orders placed through the Website.

Nothing in these Terms or in that Policy limits any statutory rights you have, including rights relating to goods that are faulty, damaged, misdescribed or otherwise do not comply with applicable consumer law, or any applicable statutory right to cancel a distance contract.

If Bevendo or the Retail Partner cancels a confirmed order and you are entitled to a refund, we will arrange the refund to the original payment method or another lawful method where necessary.

10. If Something Goes Wrong

Please contact Bevendo at info@bevendo.co.uk if there is a problem with your:

  • order;
  • product;
  • delivery;
  • payment; or
  • customer experience.

Bevendo will act as the customer-facing point of contact and, where necessary, coordinate with the relevant Retail Partner or delivery provider.

The Retail Partner remains responsible as seller for the products it supplies.

Bevendo remains responsible for its own obligations, including the operation of the Website and any delivery service for which Bevendo is responsible.

Complaints are handled in accordance with Bevendo’s Complaints Policy.

Refunds, returns and replacements are handled in accordance with the Refund and Returns Policy.

11. Ask Bevendo and Website Content

Ask Bevendo may use artificial intelligence to provide wine recommendations and general information.

Its responses are intended to help you explore products and preferences and should be considered alongside the product information shown on the Website and, where relevant, the product label.

We take reasonable care over Website content but cannot guarantee that all content will always be complete, current or error-free.

If we are informed of any inaccuracies, we will take reasonable steps to correct them.

12. Intellectual Property

The Website, Bevendo branding and the content made available through Bevendo are owned by or licensed to Bevendo or its licensors.

You may use the Website and its content for your personal, non-commercial use.

You must not copy, reproduce, distribute, scrape, reverse engineer or commercially exploit the Website or its content except where permitted by law or with our written permission.

13. Our Responsibility to You

We are responsible for loss or damage you suffer where it is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill in providing services for which we are responsible.

We are not responsible for loss or damage that is not foreseeable.

The Retail Partner is responsible to you for the products it sells.

This does not remove any responsibility Bevendo has for its own acts, omissions or services.

We do not exclude or limit liability where it would be unlawful to do so, including liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation; or
  • any consumer rights that cannot lawfully be excluded or limited.

Bevendo is intended for personal, non-commercial use.

We are not responsible for any business losses arising from use of the Website for commercial purposes.

14. Privacy and Cookies

We process personal information in accordance with our Privacy Policy.

Our use of cookies and similar technologies is explained in our Cookie Policy.

15. Refusing, Suspending or Ending Access

We may refuse an order, restrict access to the Website or suspend or close an account where reasonably necessary to protect customers, Retail Partners, delivery personnel or Bevendo, or where we reasonably suspect:

  • fraud;
  • unlawful activity;
  • misuse of the Website;
  • abuse; or
  • a material breach of these Terms.

Nothing in this section affects your statutory rights or prevents you from making a valid complaint or claim.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes to our services, technology, business model or legal requirements.

Where a change materially affects your rights, we will notify you where appropriate.

Changes will not alter the terms applying to an order that was already confirmed before the change took effect, unless required by law.

17. Other Terms

If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

If we delay enforcing a right under these Terms, that does not mean we have waived that right.

These Terms are governed by the law of England and Wales.

If you live in England or Wales, you can bring legal proceedings in the English and Welsh courts.

If you live in Scotland, you may bring proceedings in the Scottish or English courts.

If you live in Northern Ireland, you may bring proceedings in the Northern Irish or English courts.

These Terms should be read together with the other Bevendo policies made available on the Website, as updated from time to time.

Specific promotions may also have separate promotional terms.
